Upcoming changes to the Motor Vehicle Sales Act (2003)

Over the last 12 months, Regulatory Systems (Economic Development) Amendment Bill (No.3) has progressed through Parliament.

The changes to the Motor Vehicle Sales Act 2003 (the Act) are minor.

Key changes to be aware of include:

  • new information requirements for an application for registration.
  • an obligation to notify the Registrar that a new person is involved in the management of a registered company within 20 working days and changes to the information that must be provided.
  • changes to the information required to be contained on the register.
  • changes to the terms for sufficient service of a notice.
  • Removing service by fax and adding service by email (with specified exceptions).

The Bill had its third reading in Parliament on 25 March 2025 and received Royal Assent on 29 March 2025. The changes to the Act will come into force at a later date. The commencement date will be set by an Order in Council.
